Rob Kardashian Could Face Jail Time For What He Did To Blac Chyna Yesterday

All day yesterday, the talk of the town…of the nation really, was this Rob Kardashian drama with Blac Chyna. In case you missed it, Rob was posting nude images of Chyna on Instagram, claiming that she had had her body augmented (news to no one), saying that she had slept with men the same day she’d slept with him, claiming that she was a negligent mother.

And despite warning from a couple of celebrities, including Snoop and T.I., telling him that it was best to just take his L and move on, Rob persisted. To the point that Instagram deactivated his account.

He then took his tirade to Twitter.

While the whole thing read as comedic to some folks–pause– I should note here that the official Twitter account for Dru Hill had a hilarious reaction.


But besides that, what Rob did yesterday, violated laws, specifically California’s revenge porn one.
Attorneys told the New York Daily News they believe Kardashian violated California’s law enacted in 2013.

The law describes revenge porn as sharing the image of an “intimate body part of another identifiable person, or an image of that person engaged in sexual intercourse, sodomy, oral copulation or masturbation.”

The person, as Rob did, must intentionally distribute the image though the understanding was that it would be kept private and the person must have done so with the intent to cause emotional distress.

As of Wednesday, an investigation had not been opened but Elisa D’Amico, an expert on revenge porn cases at K&L Gates who also helps lead the Cyber Civil Rights Legal Project in Miami, said, “It’s more difficult to pursue without the victim’s cooperation, but with something like this, I imagine many eyes are looking already. It’s fairly high profile. A lot of lawyers are already up in arms.”

Though one revenge porn expert believes nothing will come of this as everything the Kardashians do is scripted to drive profits.

Another lawyer suggested that given the parties involved, Blac Chyna, the case may be a difficult one to see through.

“There are so many truly tragic cases out there, but this one is a little messy because of the people involved and how they monetize their bodies in celebrity culture,” Eric Johnstone said. “They monetize abuse and harassment.”

Eric sounds like a victim of the patriarchy. You don’t have to be a fan of Blac Chyna to understand that she was violated. And her choosing to share images of her body with the world and Rob doing it without her consent as a way to get even are two totally different things.

If Chyna does press charges and Rob is convicted, the criminal penalty is up to six months in jail. And if she sues for distress and emotional damages, the fact that he shared these images with his millions of followers, she too could walk away with millions.

I think she absolutely should do so.
